Updated: What to do with the revised Privacy Notice and Consent form

First, discard any old copies of the form and ensure you are using the latest form, dated July 2019 in the bottom right corner.

Next, learn what has changed in the newest update.

Note: The Primary and Secondary uses set out on the form have now been numbered. The Secondary uses are optional and include initial boxes so your clients can opt out from any or all of these Secondary uses:

2. a) The REALTOR® to whom you are giving this consent (or their brokerage) may communicate with you in the future to determine whether you require additional real estate services.

2. b) The REALTOR® to whom you are giving this consent (or their brokerage) may communicate with you to provide information about other products or services that may interest you.

2. c) Other REALTORS® may communicate with you to determine if you require additional real estate services.

2. d) The boards, and other REALTORS® or their brokerage (and survey firms on their behalf) may communicate with you to participate in surveys.

If THERE ARE Secondary use opt outs:

  • A copy of the signed form must be submitted to your Brokerage whether there is an opt out or not.
  • If clause 2. a) or 2. b) has an opt out, these relate to the REALTOR® and their brokerage, who must comply with these opt outs. Brokers will need to determine office policies and procedures for this.
  • If clause 2. c) or 2. d) has an opt out, then your brokerage must also submit a copy of the signed form to the Board for processing at mls@fvreb.bc.ca.

What the Board will be doing:

When the Board receives a form with an opt out for clause 2. c) the Board will flag the listing as Privacy Protected.

  • A notation of “PRIVACY – DO NOT SOLICIT” will be added to the REALTOR® remarks on Paragon.
  • A Privacy flag will be set within the listing on Paragon. The Owner’s name field will then display with the notation **Privacy Protected** in front of the Seller’s name.
  • When the listing goes off market, the Seller’s name is automatically removed from the Owner’s name field, which will then display only “**Privacy Protected**.” The notation in the REALTOR® remarks remains regardless of the status of the listing.

The Board is currently in discussions with partner boards to determine the best way to accommodate an opt out for clause 2. d). We will have information for you on this very soon.

If there are NO Secondary use opt outs:

You need to provide a copy of the Privacy Notice and Consent form to your office. However, your brokerage does not need to send the Board a copy.
