Professional Conduct Case Study #314: Breach of Standards

Case Study 314 examines a REALTOR® who breached CREA Standards of Business Practice – Article 22.

Article 22 provides: “The principal of a brokerage is required to supervise and control the activities of the REALTOR® and other personnel for whom he/she is responsible.”

This case went to a Professional Conduct hearing in 2021 where the hearing panel determined that the member was in breach of Article 22. The hearing panel then determined that the member be reprimanded and issued a letter of caution and be required to pay one-third of the hearing expenses.

The member appealed the hearing decision and was heard by the FVREB Appeal Board in 2022, which dismissed the appeal. That same year, the member petitioned the BC Supreme Court (BCSC), seeking to set aside both the Hearing Decision and the Appeal Decision. The BCSC dismissed petition in 2023, and the member appealed the BCSC decision to the BC Court of Appeal (BCCA) in 2024. On January 9, 2025, the BCCA dismissed the member’s appeal.
